Welcome to Tesoro's

Tesoro—meaning "Treasure" in Italian—has been a family-owned destination for casual comfort, friendly service, and fine food since 1981. These Terms of Service ("Terms") govern your use of our website, reservation services, dining experiences, private events, gift cards, mailing list, SMS program, and other services we offer.

By using our website, making a reservation, dining with us, booking an event, purchasing a gift card, or subscribing to our communications, you agree to these Terms. Please read them carefully.

GENERAL TERMS

 

1. Acceptance of Terms

By accessing our website or using any of our services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and agree to be bound by these Terms. If you do not agree, please do not use our services.

Parents or guardians are responsible for any use of our services by minors under their supervision.

Permitted Use

Our website is provided for your personal, non-commercial use to learn about Tesoro's, view our menus, make reservations, sign up for our mailing list, and contact us.

Prohibited Conduct

The Tesoro's name, logo, and related marks are trademarks of Tesoro's Restaurant. Unauthorized use is prohibited.

RESERVATIONS

 

5. Making a Reservation

Reservations can be made by phone at (516) 334-0022, through our website, or through third-party platforms such as OpenTable, Yelp, or Google.

When making a reservation, you agree to provide accurate information including your name, phone number, party size, and any special requests. Please inform us of dietary restrictions, food allergies, or accessibility needs so we can prepare for your visit.

6. Reservation Policies

Confirmation

Reservations are not guaranteed until confirmed. You may receive a confirmation via phone call, email, or text message depending on your contact preferences.

Arrival Time

Please arrive on time for your reservation. We will hold your table for 15 minutes past your reservation time. After 15 minutes, we may release your table to other guests, especially during busy periods.

If you are running late, please call us at (516) 334-0022 so we can accommodate you if possible.

Cancellations and No-Shows

If your plans change, please cancel your reservation as soon as possible so we can offer your table to other guests. You can cancel by calling us or through the platform you used to book.

Repeated no-shows may result in restrictions on future reservations.

Large Party Reservations

For parties of 8 or more, special terms may apply, including set menus, deposits, or minimum spend requirements. Please contact us directly to arrange large group reservations.

7. Waitlist

During busy times, we may offer a waitlist for guests without reservations. If you join our waitlist and opt in to text notifications, we will send you a message when your table is ready. Waitlist times are estimates and not guaranteed. If you leave the premises, please stay nearby and respond promptly when we notify you, or your place on the waitlist may be forfeited.

DINING EXPERIENCE

 

8. Menu and Pricing

Our menu offerings and prices are subject to change based on seasonality, availability, and other factors. While we make every effort to keep our website and printed menus current, the most accurate menu and pricing information is available in-restaurant.

Some menu items may contain allergens or may not be suitable for all dietary needs. Please inform your server of any food allergies or dietary restrictions before ordering. While we take precautions, we cannot guarantee a completely allergen-free environment due to the nature of restaurant kitchens.

9. Conduct

We want all guests to enjoy their experience at Tesoro's. We reserve the right to refuse service to or remove any guest who:

  • Is disruptive to other guests or staff

  • Engages in illegal activity

  • Violates our dress code (smart casual attire is appreciated)

  • Appears to be excessively intoxicated

  • Harasses or threatens staff or other guests

10. Alcohol Service

We serve alcoholic beverages in compliance with New York State liquor laws. You must be 21 years of age or older to purchase or consume alcohol. We reserve the right to request identification and to refuse alcohol service to anyone who cannot provide valid ID or who appears intoxicated.

11. Payment

We accept major credit cards, debit cards, and cash. Prices listed on our menus do not include applicable taxes and gratuity unless otherwise noted.

For dine-in service, payment is expected at the conclusion of your meal. We reserve the right to pursue payment for any unpaid charges.

Gratuity may be automatically added for parties of 6 or more.

PRIVATE EVENTS AND PARTIES

 

12. Private Event Bookings

Tesoro's offers private and semi-private dining options for special occasions, corporate events, and celebrations. To book a private event, please contact us at (516) 334-0022 or through our website.

Event Agreements

Private events may require a signed event agreement outlining menu selections, guest count, pricing, payment terms, and other details. The event agreement, together with these Terms, governs your private event booking.

Deposits and Payment

Private events may require a non-refundable deposit to secure your date. Remaining balances are typically due on or before the event date. Specific payment terms will be outlined in your event agreement.

Guest Count

A final guest count is typically required 5-7 business days before your event. You will be charged based on the confirmed guest count or the actual number of guests served, whichever is greater.

Cancellations

Cancellation policies for private events vary based on the size and nature of your event and will be specified in your event agreement. Deposits are generally non-refundable, and cancellations within a certain period may result in additional charges.

GIFT CARDS

 

13. Gift Card Terms

Tesoro's gift cards are available for purchase in-restaurant and may be available online. Gift cards are redeemable for food and beverages at Tesoro's Restaurant.

Terms and Conditions

  • Gift cards are not redeemable for cash except where required by law

  • Gift cards cannot be replaced if lost, stolen, or damaged

  • Gift cards do not expire and no dormancy fees apply (in compliance with New York State law)

  • Gift cards may not be resold

  • We are not responsible for unauthorized use of gift cards

ONLINE ORDERING AND TAKEOUT

 

14. Takeout Orders

If you place a takeout order by phone or through our website, you agree to provide accurate contact and payment information. Prices for takeout items may differ from dine-in prices.

Order Acceptance

All orders are subject to acceptance by Tesoro's. We reserve the right to refuse or cancel orders for any reason, including item unavailability, suspected fraud, or errors in pricing.

Pickup

Please pick up your order at the designated time. Orders not picked up within a reasonable time may be discarded, and refunds may not be available.

Quality

Takeout food is best consumed promptly. Tesoro's is not responsible for food quality or safety after the order leaves our premises.

15. Email Communications

By joining our mailing list, you agree to receive promotional emails from Tesoro's including special offers, event announcements, seasonal menus, and restaurant news.

You may unsubscribe at any time by clicking the "unsubscribe" link in any email. Please allow up to 10 business days for your request to be processed.

We will not sell or share your email address with third parties for their marketing purposes.

SMS TEXT MESSAGING PROGRAM

 

16. Program Description

The Tesoro's Restaurant SMS Program allows you to receive text messages about reservations, special offers, and restaurant news. By opting in, you agree to receive recurring automated SMS and MMS messages from Tesoro's at the mobile number you provided.

Types of Messages You May Receive:

Reservation and Dining Messages

  • Reservation confirmations and reminders

  • Waitlist notifications ("Your table is ready!")

  • Modification and cancellation confirmations

Promotional Messages

  • Weekly specials and chef's features

  • Happy hour announcements

  • Seasonal and holiday menu launches

  • Exclusive subscriber offers

  • Birthday and anniversary greetings

  • Gift card promotions

Restaurant Updates

  • Holiday hours and closures

  • Special event announcements (wine dinners, live music, themed evenings)

  • Important restaurant news

Message Frequency: Message frequency varies. You may receive approximately 2-8 messages per month depending on promotional activity and your reservation activity.

17. Consent

By providing your mobile phone number and agreeing to receive text messages, you expressly consent to receive recurring automated marketing and informational messages from Tesoro's Restaurant.

Consent is not a condition of making a purchase or dining with us. You may enjoy Tesoro's without participating in our SMS program.

18. Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to the phone number from which you received our message.

Upon sending "STOP," we will send a confirmation message. After confirmation, you will no longer receive SMS messages from us.

To rejoin after opting out, sign up as you did initially—through our website, in-restaurant sign-up, or by texting JOIN to our number—and we will resume sending messages to you.

Important: If you opt out of text messages, you will no longer receive reservation reminders or waitlist notifications via SMS. Please ensure your email subscription is active or call us directly to confirm reservations.

20. Message and Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies.

For questions about your text or data plan, please contact your wireless carrier.

21. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

Tesoro's is not responsible for messages that are undelivered or delayed due to:

  • Wireless carrier network issues

  • Device incompatibility or technical problems

  • Service outages or interruptions

  • Changes to your mobile number or wireless service

If you have an upcoming reservation and have not received a confirmation, please call us directly at (516) 334-0022.

22. Supported Carriers

Our SMS program is designed to work with major U.S. carriers including AT&T, Verizon, T-Mobile, and others. Not all carriers support all message types, and delivery may vary by carrier and device.

23. SMS Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services necessary to deliver your messages.

24. SMS Program Eligibility

To participate in our SMS program, you must:

  • Be at least 18 years of age

  • Be a resident of the United States

  • Be the account holder for the mobile number provided, or have the account holder's authorization

  • Agree to these Terms of Service

25. SMS Program Compliance

Our SMS program is operated in compliance with:

  • The Telephone Consumer Protection Act (TCPA)

  • The CAN-SPAM Act

  • Cellular Telecommunications Industry Association (CTIA) guidelines

  • All applicable federal and state laws

We are committed to responsible messaging and will never send illegal, deceptive, or harmful content.

26. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

27. Limitation of Liability

To the fullest extent permitted by law, Tesoro's Restaurant, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use our website or services

  • Any errors or omissions in our content

  • Unauthorized access to or alteration of your information

  • Statements or conduct of any third party

  • Undelivered, delayed, or misdirected text messages

  • Any other matter relating to our services

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to Tesoro's in the 12 months preceding the claim.

These limitations apply regardless of the legal theory upon which your claim is based.

28. Indemnification

You agree to indemnify, defend, and hold harmless Tesoro's Restaurant, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms

  • Your use of our services

  • Your violation of any rights of a third party

  • Any content you submit to us

29. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Nassau County, New York. You consent to the personal jurisdiction of these courts.

30. Dispute Resolution

31. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy and any event agreements you may sign, constitute the entire agreement between you and Tesoro's regarding your use of our services. These Terms supersede any prior agreements or understandings.

33. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Tesoro's to be effective.

34. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
